1. Acceptance of Terms
By using Spomyn, you agree to these Terms of Use and our Privacy Policy. If you do not agree to all of these terms, you must not use the application. We reserve the right to modify these terms at any time, and your continued use of the app constitutes acceptance of those changes.
2. Hiking & Outdoor Safety Disclaimer
Outdoor activities are inherently dangerous. You use Spomyn entirely at your own risk.
Spomyn is designed as a supplementary navigational aid. It is NOT a replacement for common sense, physical topographical maps, compasses, or professional wilderness experience.
- Data Inaccuracies: Map data and Points of Interest (POIs) may contain errors. A path or bridge shown on the map may be closed, dangerous, or completely non-existent in reality.
- GPS Limitations: Device GPS can fail, lose signal, or drain your battery unexpectedly. Never rely solely on a digital device for survival in the wilderness.
- No Liability: We are not liable for any injuries, damages, search and rescue costs, or loss of life that occur while using the app. You are solely responsible for your route planning and personal safety.
3. Map Data & Third-Party Services
Spomyn utilizes map data sourced from OpenStreetMap and other third-party providers. This data is provided "as is" and "as available." We do not guarantee the accuracy, completeness, or reliability of any maps, trails, or geographic information displayed in the app.
4. Your Data & Responsibilities
Spomyn is a privacy-first application. Your journal entries, visit logs, and GPS tracks are stored locally on your device.
- You are entirely responsible for backing up your data using the app's
.spomynexport feature. - If you lose your device, uninstall the app, or experience a hardware failure without a backup, your data is permanently lost. Spomyn cannot recover it for you, as we do not have access to it.
5. Purchases & "Pro" Tier
Certain features of Spomyn may be locked behind a "Pro" tier or other in-app purchases. All transactions are securely handled directly by the Apple App Store or Google Play Store. Because we do not process payments, any requests for refunds, cancellations, or billing inquiries must be directed to the respective app store according to their specific terms and policies.
6. Intellectual Property
The Spomyn app, including its original code, design, logos, and UI, is the property of Spomyn. You may not reverse engineer, decompile, distribute, or create derivative works from the application without our express written permission.
7. Limitation of Liability
To the maximum extent permitted by law, Spomyn and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app. The application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
